Functions and duties of the department of Labor, Invalids and Social Affairs

1. Functions:
The department of Labor, War Invalids and Social Affairs is a specialized agency under the People's Committee of Tra Vinh province, advises and assists the Provincial People's Committee in performing the function of the state management over the domains of employment; vocational training; labor; salary; social insurance (compulsory social insurance, voluntary social insurance, unemployment insurance), labor safety; people with merit; social protection; children protection and care; gender equality; social evils prevention and fight (collectively referred to as labor, people with merit and society); on public services within the scope of state management of the department and performs some other tasks and powers as decentralized and authorized by the Provincial People's Committee and in accordance with the law.
2. Duties and powers:
2.1. Submits to the Provincial People's Committee:
a/ Decision and directive drafts on laborers, people of merit and society within the scope of the state management of the department;
b/ Long-term, five-year and annual plans, programs and projects under the department’s management in line with the local socio-economic development master plan;
2.2. Submits to the Chairman of the Provincial People's Committee:
a/ Decision and directive drafts on laborers, people of merit and society within the scope of the state management of the department;
b/ Elaborating a scheme to submit to the Provincial People's Committee for promulgation the decisions on establishment, dissolution and merger of the units under the department’s management in accordance with the provisions of law.
2.3. Guides, examines and organizes the implementation of legal documents, plans, schemes, programs and other issues on labor, people with merit and society after they are approved; organizes information, propagates, guides and disseminates the law on the domains under its assigned management.
2.4. Employment, insurance and unemployment:
a/ Organizing the implementation of programs and solutions on employment and policies on development of the labor market of the province on the basis of the national target program on employment;
b/ Guiding and realizing the provisions of law on:
- Unemployment insurance;
- Indicators and solutions for creating new jobs;
- Policies on job creation in enterprises, cooperatives, collective and private economic forms;
- Organizing the management and use of labor resources; labor market information;
- The employment policy for specific labor (minors, the disabled, the elderly and other subjects), laborers working at home, displaced laborers;
- Issuing labor books, monitoring the management and using labor books.
c/ Managing job placement organizations according to the provisions of law;
d/ Granting, changing and withdrawing work permits for foreign laborers working in enterprises and economic organizations in the provinces according to the provisions of law.
2.5. Vietnamese laborers working overseas under contracts:
a/ Guiding and organizing the sending of Vietnamese laborers working overseas according to local contracts according to the provisions of law;
b/ Propagating and disseminating the state's undertakings, policies and laws on Vietnamese laborers working overseas under contracts;
c/ Guiding and organizing the training of labor sources and the selection of laborers to work overseas under the State management;
d/ Guiding and inspecting the registration of contracts of enterprises and guest workers according to individual contracts; supervising the performance of contracts by enterprises sending laborers to work abroad in the form of skill improvement internship;
e/ Making statistics on the number of enterprises which send Vietnamese laborers to work abroad under contracts in their respective provinces; the number of laborers going to work overseas under contracts;
 f/ Notifying the person terminating the labor contract in foreign countries returning to the country of recruitment demand in the country; guiding and recommend laborers to register for employment;
 g/ Assuming, coordinating with concerned agencies in, settling requests and proposals of organizations and individuals in the field of Vietnamese laborers going to work overseas according to their competence.
2.6. Vocational training:
 a/ Organizing the implementation of, plans, programs and projects on development of vocational training in localities after they are approved;
 b/ Guiding and inspecting the organization of implementation of the law provisions on job training; standards of teachers and vocational managers; enrollment regulations, examination regulations, graduation examination and certification, and the granting of diplomas and certificates; the policies and regimes applicable to managerial officials, vocational trainers and trainees and students according to the provisions of law;
 2.7. In terms of labor, salary and wage:
 a/ Guiding the performance of labor contracts, collective labor agreements, negotiation and signing of collective labor agreements; labor discipline and material responsibility; resolving labor disputes and strikes; the regime for laborers in reorganizing and transforming state enterprises, bankrupt enterprises, dissolved enterprises, equitized enterprises, enterprises selling or contracting enterprises;
 b/ Guiding the implementation of wage and wage regimes in accordance with the provisions of law.
2.8. In the field of compulsory social insurance and voluntary social insurance:
a/ Guiding, inspecting and handling violations in the implementation of the law provisions on compulsory social insurance and voluntary social insurance according to its competence;
b/ Receiving dossiers and organizing the appraisal of conditions for suspension of payment of compulsory social insurance premiums for the Provincial People's Committee to consider and decide;
c/ Implementing regimes and policies on social insurance according to the decentralization or authorization of the Provincial People's Committee according to the provisions of law.
2.9. In the area of labor safety:
a/ Guiding and organizing the implementation of the national program on labor protection, labor safety and labor hygiene; the national labor safety, labor hygiene and fire and explosion prevention and fighting in the province;
b/ Organizing the training and granting of certificates of occupational safety and health training to employers in the province;
c/ Complying with the regulations on registration of machines, equipment and supplies subject to strict labor safety requirements in localities according to law provisions;
d/ Guiding the inspection of the quality of specific products and goods on labor safety according to the provisions of law.
e/ Assuming and coordinating with one another in, organizing the investigation of serious occupational accidents occurring in their respective localities; summing up and report to the Provincial People's Committee and the Ministry of Labor, War Invalids and Social Affairs on the situation of labor accidents in their respective localities; guiding organizations and individuals employing laborers to make declarations, investigations, make records, statistics and report on labor accidents.
